DMCA Copyright Policy

1. Overview

BriskTool ("BriskTool," "we," "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using the BriskTool service (the "Service") that are reported to our designated copyright agent.

2. Copyright Infringement Notification

If you believe that content available on or through the Service infringes one or more of your copyrights, please submit a written notification ("DMCA Notice") to our designated copyright agent containing the following information:

1. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
2. Identification of the infringing material and information reasonably sufficient to permit us to locate the material on the Service (e.g., a URL or specific description).
3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
6. Your physical or electronic signature (full legal name typed counts as an electronic signature).

3. Designated Copyright Agent

4. Counter-Notification Procedure

If you believe that material you posted on the Service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification ("Counter-Notice") with us. Your Counter-Notice must contain the following:

1. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
3. Your full legal name, mailing address, and telephone number.
4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside of the United States, the Middle District of Tennessee), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
5. Your physical or electronic signature.

Upon receipt of a valid Counter-Notice, we will forward it to the party who submitted the original DMCA Notice. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days of receiving the Counter-Notice, we will restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith Requirement

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Before filing a DMCA Notice, please make sure that you actually have the right to make such a claim. We suggest consulting with an attorney if you are unsure.

7. Modifications

We reserve the right to modify this DMCA policy at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated policy.
